Department of Labor Fact Sheets re: Hours Worked; Overtime Pay; Child Labor

The Department of Labor has been focusing on the long term care profession's (nursing homes and assisted living) compliance with the Fair Labor Standards Act for nearly a decade. Specifically, DOL is focusing on hours worked, overtime pay and child labor. These are the three areas where the LTC profession has the most challenges.

Three years ago, AHCA/NCAL worked with the Department of Labor to develop facts sheets about compliance with these three areas. AHCA/NCAL has widely publicized the DOL's efforts but compliance levels fall short of the DOL's goal of a 90 percent compliance level. NF's compliance is about 55% and assisted living is about 70%.

DOL is currently working on a full compliance manual for the LTC profession. Volunteers from AHCA's and NCAL's workforce committees will review the draft manual this summer and provide comments to DOL. The final manual is scheduled to be completed this Fall.
